Terms of service
The terms that apply when you work with The Digital Engine. Last updated 12 October 2026.
1. Who we are
The Digital Engine is the trading name of Croíadh Molloy, a sole trader based in Co. Kerry, Ireland, providing AI and automation services to businesses. You can contact us at hello@thedigitalengine.ie. These terms apply to all services we provide.
2. AI Assistant Setup & Training
What's included. A short questionnaire before the session; preparation using the business information you supply; setup of one workspace in one AI tool we agree with you, such as Claude or ChatGPT, using the features available on your chosen plan; your services, audience, tone of voice, priorities and useful reference material added as context; three everyday tasks we agree to practise; a 90-minute online session covering setup, demonstration and hands-on practice; a short personalised getting-started guide; and one 20-minute follow-up call within 14 days of the session.
Your AI account. You use and own your account with the AI provider, and any subscription is paid by you directly to that provider. It isn't included in the price. We'll agree the tool, and tell you what plan you need, before the session. You log in yourself: we'll never ask for your password. What you add to your workspace is processed by the provider under your agreement with them.
What isn't included. Ongoing support beyond the one follow-up call, more than one AI tool, finished content or graphics, connecting other apps, automatic sending or posting, and custom integrations. These can be quoted separately. The session isn't legal, tax or data protection advice. AI tools can make mistakes, so you're responsible for checking anything it produces before you use or send it.
Price. €179. We aren't registered for VAT, so no VAT is added.
Booking and payment. You send an enquiry through our website or by email. Sending an enquiry isn't a booking. If it's a good fit, we'll offer you a time and send payment details. Payment is due in full before the session, and your time is confirmed once payment is received.
Rescheduling. You can reschedule once, free of charge, if you tell us at least 24 hours before the session. Further changes are at our discretion.
Cancellations and refunds. If you cancel at least 24 hours before the session, we'll refund you in full. If you cancel with less notice, or miss the session, the fee isn't refundable. If we need to cancel or move the session, you can choose a new time or a full refund.
Follow-up call. The 20-minute follow-up call is available within 14 days of your session. We'll arrange a time with you when you ask for it.
Further work. The €179 fee is for this package and isn't credited against any later work. Any further training or implementation is optional and quoted separately.
3. Other services
For setups and bigger projects, what we'll deliver, the price and any ongoing support are agreed in writing before work begins. We may improve how a system works where this keeps or improves the agreed functionality.
4. Setup fees and payment
Setup fees are invoiced on signing and are non-refundable once delivery is confirmed. Delivery means all agreed automations are live in your account, each has been tested with at least three documented successful runs, and a walkthrough has been completed with you or your nominated contact.
For larger projects, a 50/50 payment plan is available: 50% on signing and 50% on go-live. Each payment is non-refundable once its milestone is reached.
We aren't registered for VAT, so no VAT is added to any of our prices. If that changes, we'll tell you in writing before it affects anything you pay.
Monthly subscription fees are charged in advance on the same date each month. We'll give 30 days' notice of any price change.
5. Usage-based services and third-party costs
AI processing. Normal AI processing used by the automations we install is included in the monthly subscription, within the level of use agreed in your quotation. Your quotation sets that level based on the volumes you tell us about. We won't add AI processing charges without agreeing them with you first: if your use is regularly well above the agreed level, we'll contact you before anything changes and agree a fair approach.
Text messaging and voice. Some automations use third-party services that charge by usage, such as text messaging (Twilio) and voice (Vapi). These costs aren't included in the monthly subscription.
For text and voice services, you set up your own account with your own payment card, and we configure it for you. Usage is billed to you directly by the provider, and we don't receive any part of those charges. We'll estimate expected costs before go-live.
For website chatbots, if usage significantly exceeds the agreed guidance level, we'll contact you before any extra charge and agree a fair approach. We'll never incur costs on your behalf without your approval.
6. Monthly subscriptions and cancellation
Automation subscriptions are monthly rolling, with no minimum term. You can cancel at any time by giving 30 days' written notice by email to hello@thedigitalengine.ie. Your subscription ends at the end of the notice period, and the monthly fee is payable up to that date. Setup fees already paid aren't refunded.
When a subscription ends:
- we switch off the workflows we run for you, so they stop replying to, sorting or sending messages;
- we remove our access to your accounts, and return or delete any passwords, keys or other credentials you gave us;
- data held in your own accounts, such as your Gmail, Google Sheets and any logs we set up there, stays yours and isn't affected;
- any of your customers' personal data we hold on your behalf, for example in our system logs, is returned to you on request and then deleted, unless the law requires us to keep it. Your data processing agreement sets out how and when this happens, and we'll confirm in writing once it's done;
- if you'd like the setup documented or handed over to someone else, we can quote for that separately.
If a larger project needs different terms, they'll be set out in the written agreement before you sign.
7. Data protection
When we build or run systems that handle your customers' personal data, you are the data controller and we act as your data processor. We'll put a written data processing agreement in place with you before we process that data. How we handle information you give us directly is set out in our privacy policy.
Where a system uses AI to communicate with your customers, we'll agree with you how that's made clear to them.
8. Liability
We build and test our systems carefully, but no software is infallible. We aren't liable for lost revenue, missed opportunities or other business impacts arising from system downtime, third-party service outages, or AI-generated content. We'll work to resolve issues promptly, at no extra charge while your subscription is active.
9. Governing law
These terms are governed by Irish law.
